北京胡同私有祖宅業主華新民等請求全國人大釋憲

致全國人大常務委員會：
在此附上我們28位北京胡同祖宅業主給北京市長郭金龍先生的壹封信，其目的之壹旨在請求撤銷北京市國土資源局最近公布的（2010）京國土籍462號文。tvb now,tvbnow,bttvb7 ~; S; R" Q9 V- K# q8 {

這封信的內容涉及到了對1982年《中華人民共和國憲法》第十條：“城市的土地屬於國家所有”這壹規定的解讀。5.39.217.77:8898$ t; m  Y& r; Y2 F# `0 ~

由於憲法中規定了全國人大常務委員會的職權之壹是解釋憲法，所以我們在此請求全國人大常務委員會對上面這條規定作出解釋。

我們希望知道：

1，這個“所有”是行政意義、政治意義、主權意義和象征性的“所有”，還是財產權意義上對實物土地的“所有”？5.39.217.77:88984 a6 [+ R; i! m+ ~9 F
2，如果是財產權意義上的“所有”，是否包含1982年之前已經存在的城鎮私有宅基地的土地？5.39.217.77:8898) ]* Y8 l  W# L; k3 {4 K
3，如果包含的話，那麽公民對自己財產的所有權是以怎樣的程序和理由轉移的？如果是“沒收”，希望有關部門能公布沒收的程序和理由。
4，如果是財產權意義上的“所有”，但不包含當時已經存在的城鎮私有宅基地，請公開作出說明。
5，如果不是財產權意義上的“所有”，也請公開作出說明。

We hereby attach a letter written to Mr. Guo Jinlong, Mayor of Beijing Municipality，by 28 owners of inherited alley (hutong) homesteads in Beijing. 1. Does the term “belongs to”, as used in Article 10 of the Constitution, mean "belongs to" in the sense of having an administrative, political, sovereign and/or symbolic right? Or does it mean “owns” the real land in the sense of having a property right?
